Terms of Service

These Terms of Service govern access to and use of the Court Banter website, store, content, and related services. By using the site or placing an order, you agree to these Terms and to the policies incorporated by reference. If you do not agree, do not use the services.

Store operator

Court Banter is currently operated as a sole proprietorship. References to Court Banter, we, us, and our mean the store operator. Contact: support@courtbanter.com. Mailing address: 1223 Cleveland Ave #200, San Diego, CA 92103.

Eligibility and permitted use

You must be able to enter a binding contract in your jurisdiction to place an order. If you use the services for another person or organization, you represent that you have authority to bind them. You may use the services only for lawful personal or business purposes consistent with these Terms.

Products and display

We make reasonable efforts to describe and display products accurately. Screen settings, lighting, fabric blends, production batches, and print processes may create minor differences in color, texture, dimensions, or placement. Images may include styling or mockups. Such minor variations are not necessarily defects.

Product availability, sizes, colors, descriptions, and prices may change without notice. We may limit quantities or discontinue products where permitted by law.

Made to order production

Shirts are printed after purchase. Production may begin soon after payment authorization. Contact us immediately to request a change or cancellation; we cannot guarantee it after production begins. Return eligibility is governed by the Return and Exchange Policy.

Orders and acceptance

An order confirmation acknowledges receipt but does not necessarily constitute final acceptance. We may refuse or cancel an order for legitimate reasons, including suspected fraud, pricing or listing errors, payment problems, inventory or production limitations, shipping restrictions, or violation of these Terms. If we cancel after payment, we will issue an appropriate refund.

Prices, taxes, and payment

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, and other disclosed charges are calculated at checkout. Accepted payment methods are those displayed at checkout and may be processed through Shopify Payments or other payment providers. You represent that you are authorized to use the payment method submitted.

If a product or price is listed incorrectly, we may correct the error and, where permitted by law, cancel the affected order and refund the amount paid. We will not add undisclosed charges after checkout.

Shipping, title, and risk

Shipping is governed by the Shipping Policy. Delivery dates are estimates unless expressly guaranteed. Title and risk of loss transfer as provided by applicable law and the carrier arrangement; nothing in these Terms removes rights that cannot legally be waived.

Returns and refunds

Returns, exchanges, defects, and refunds are governed by the Return and Exchange Policy. Review that policy before purchasing, including its 30-day request period, item-condition requirements, exclusions, and customer responsibility for preference-based return shipping.

Intellectual property

The Court Banter name, logos, artwork, graphics, photographs, product designs, text, and other store content are owned by or licensed to Court Banter and are protected by applicable intellectual-property laws. Except as expressly allowed, you may not copy, reproduce, modify, distribute, sell, create derivative works from, or commercially exploit store content without written permission.

Reviews and submissions

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the necessary rights and that the submission is accurate, lawful, and does not violate another person's rights. You grant Court Banter a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission for store operation and promotion, subject to applicable law and our Privacy Policy. We may moderate or remove submissions but are not obligated to publish them.

Prohibited conduct

• Using the services for unlawful, fraudulent, abusive, or deceptive activity
• Interfering with security, access controls, store operation, or another user's access
• Introducing malware, automated scraping, credential attacks, or unauthorized data collection
• Infringing intellectual property, privacy, publicity, or other rights
• Submitting false order, payment, return, claim, or chargeback information
• Using store content or products in a way that falsely suggests endorsement or affiliation

Third party services and links

The store may use or link to third-party services, including Shopify, payment providers, carriers, and social platforms. Their services are governed by their own terms and privacy notices. We are not responsible for third-party content or acts beyond our control, except as required by law.

Disclaimer of warranties

To the fullest extent permitted by law, the services and site content are provided on an as available basis without warranties not expressly stated in these Terms or required by law. We do not disclaim any warranty or consumer right that cannot legally be disclaimed.

Limitation of liability

To the fullest extent permitted by law, Court Banter will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from the services. To the fullest extent permitted by law, Court Banter's aggregate liability for a claim relating to a purchase will not exceed the amount paid for the product giving rise to the claim. These limitations do not apply where prohibited or to liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Court Banter harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the services, violation of these Terms, or infringement of another person's rights. This provision does not apply to the extent a claim results from Court Banter's own unlawful conduct.

Chargebacks and payment disputes

If you believe a charge is incorrect, contact support@courtbanter.com so we can investigate promptly. Nothing in this section prevents you from exercising a lawful right to dispute a payment. Knowingly submitting false information or seeking both a refund and chargeback for the same amount may constitute fraud.

Governing law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles, except that mandatory consumer protections of your home jurisdiction remain applicable where they cannot be waived.

Changes, severability, and entire agreement

We may update these Terms by posting a revised version with a new Last updated date. Changes apply prospectively unless law permits otherwise. If any provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue. These Terms and incorporated policies form the agreement concerning the services, except for additional terms expressly accepted at checkout.
